Drunk Driving (DUI)

Protecting Your Rights After a DUI Arrest

Facing DUI Charges? What You Need to Know

A DUI arrest in California is one of the most serious and stressful charges you can face. With some of the toughest penalties in the nation, even a first offense can mean license suspension, fines, probation, or jail time. At California Justice Law Group, our experienced DUI defense attorneys fight aggressively to challenge the evidence, protect your record, and pursue alternatives that safeguard your future.

What Is A DUI?

Driving under the influence (DUI) means operating a vehicle with a blood alcohol concentration (BAC) of .08% or higher, or while impaired by alcohol or drugs. California treats DUIs as “priorable” offenses, meaning penalties increase with each conviction within a 10-year period. Charges can range from a misdemeanor first offense to felony DUI with injury or vehicular manslaughter.

Potential Penalties Include:

  • First Offense: Probation (3–5 years), up to 6 months in jail, fines of $1,900+, 3–9 months of DUI school, 6-month license suspension.
  • Second Offense: Probation, 96 hours to 1 year in jail, $2,000+ fines, 18–30 months of DUI school, 2-year license suspension.
  • Third Offense: Probation, 120 days to 1 year in jail, $2,500–$3,000 fines, 30-month DUI school, 3-year license revocation

How We Defend You

A DUI charge is not a conviction. We attack unreliable breath/blood results, challenge roadside procedures, question field-sobriety validity, and investigate whether any accident was actually caused by impairment. We push for reduced counts or alternative outcomes (e.g., community service, sober living) to protect your license and record. If your case includes an eligible non-violent drug possession charge, we also pursue Prop 36 treatment in lieu of jail—aiming for rehabilitation and, when completed, potential dismissal of that drug count.
