Disposition: Jury Trial/Dismissal per PC 1118.1
J.M. was charged with misdemeanor driving under the influence and tried before a jury. A key issue in this trial was whether J.M. had in fact “driven” a motor vehicle—i.e., a “Mercer” defense. At trial, our attorneys meticulously and aggressively cross examined the state’s witnesses and articulated to the jury the holes in the prosecution’s case. The result of this rigorous defense was “reasonable doubt” in the mind of the presiding judge. At the conclusion of the prosecution’s case, the judge granted the defense motion for acquittal.
